ACCEPTING THESE TERMS AND CONDITIONS

The website www.unrealfur.com.au (Site) is operated by Unreal Fur Pty Ltd (ACN 154 435 711) of 41 Grosvenor Street, Abbotsford VIC 3067 Australia (Unreal Fur, we, us, our).

Please read these Terms & Conditions and our Privacy Policy (together, the Terms) carefully before using the Site or any other domains, products, services or content provided by Unreal Fur (collectively, the Services). By accessing or using the Services, you agree to be bound by the Terms. If you do not agree to the Terms, you must not use the Services.

 

CHANGES TO THESE TERMS

We may amend the Terms at any time by posting a revised version on the Site. Changes take effect once posted. Your continued use of the Site after a change is posted means you accept the Terms as amended, so please check back periodically. Any change made after you have placed an order will not apply to that order, unless we are required to make the change by law.

If you disagree with the Terms or any amendment, your only recourse is to stop using the Site.

We may suspend or terminate your access to the Site if you breach the Terms.

 

INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, images, photographs, logos, designs, video, audio, software and other material (Content) — is owned by or licensed to Unreal Fur and is protected by Australian and international copyright, trademark and other intellectual property laws.

Except for your own personal, non-commercial use, or as otherwise permitted under the Copyright Act 1968, you must not:

  • download, copy, reproduce, republish, retransmit or otherwise use any Content as a stand-alone file;
  • modify or create derivative works based on the Site or the Content;
  • remove or alter any copyright, trademark or other proprietary notice on the Content;
  • use any robot, scraper, spider, or other automated means to access, search or extract data or Content from the Site without our express prior written consent; or
  • otherwise use the Site or Content for any purpose other than its intended purpose.

All trademarks, logos and brand names displayed on the Site are the property of Unreal Fur (or the relevant third-party owner, where acknowledged). Nothing on the Site grants you any licence or right to use them without our express prior written permission.

 

ACCEPTABLE USE

You must not use the Site in any way that is unlawful, infringes anyone's rights, breaches these Terms, or could damage the reputation of Unreal Fur. In particular, you must not:

  • access, tamper with, or attempt to access non-public areas of the Site or our (or our service providers') systems;
  • probe, scan or test the vulnerability of any system or network, or attempt to circumvent any security or authentication measures;
  • access or search the Site by any automated means other than through our published, publicly available interfaces, unless separately agreed with us in writing;
  • scrape the Site or any Content without our express prior written consent;
  • send or transmit any virus, malware or other harmful code, or otherwise interfere with or disrupt the Site, our servers, or any other user's access to the Site;
  • send altered, deceptive or false source-identifying information (for example, forged headers); or
  • post or transmit any unlawful, obscene, harassing, defamatory, threatening or otherwise objectionable material through the Site.

If you create an account or place an order, you must provide accurate, current and complete information, keep your login details secure, and are responsible for all activity that occurs under your account.

We may cooperate with law enforcement in any jurisdiction in connection with any lawful request relating to use of the Site.

 

THIRD-PARTY LINKS

The Site may contain links to third-party websites (Linked Sites). We do not endorse, and are not responsible for, the content, accuracy, availability or practices of any Linked Site. Any use of a Linked Site is at your own risk.

 

PRIVACY

Our collection and use of your personal information is governed by our Privacy Policy, available on the Site, which forms part of these Terms. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy. We do not sell your personal information to third parties.

 

ELIGIBILITY AND ORDERS

To purchase from the Site, you must provide accurate personal details, including your name, contact details and valid payment information, and you confirm you are authorised to use the payment method provided.

Orders are subject to acceptance and availability. We reserve the right to refuse or cancel an order where reasonably necessary, including where there is a pricing or product information error, the product is unavailable, we reasonably suspect fraudulent or unauthorised activity, or the order has been placed in breach of these Terms. If we cancel an order after payment has been taken, we will provide a full refund to your original payment method.

By using the Site, you confirm that you are at least 18 years old, or that you are using the Site with the consent and supervision of a parent or legal guardian.

We may conduct reasonable checks (including credit or fraud checks) to verify your identity or payment details before processing an order. Fraudulent chargebacks may be reported to relevant authorities, banks and buy-now-pay-later providers.

 

PRICING, AVAILABILITY AND PAYMENT

We take care to ensure prices, descriptions and product information on the Site are accurate, but errors may occur. If we find a pricing error on an order you've placed, we'll contact you to reconfirm at the correct price or cancel the order; if we can't reach you, we'll cancel the order and refund you in full.

While we take care to maintain accurate stock availability on the Site, occasionally an item may become unavailable after an order has been placed. If we are unable to fulfil an item in your order, we will notify you as soon as possible and provide a full refund for that item to your original payment method.

Prices may be displayed in multiple currencies for convenience, but all transactions are processed in Australian dollars (AUD). Delivery costs are additional and shown at checkout. No order will be dispatched until payment is received in full.

 

PERSONAL USE ONLY

Unreal Fur products are sold for personal use only and must not be used for any commercial purpose (including rental) without our prior written consent. We may refuse a sale, or cancel and refund an order before shipment, if we reasonably suspect the items will be used commercially. Items purchased for rental or other commercial use are not eligible for our change-of-mind return, exchange or store credit policy. Any voluntary warranty we provide may exclude commercial use, but this does not affect any rights that cannot be excluded under applicable law.

 

DELIVERY & RETURNS

If your order does not arrive, or is lost in transit before delivery, please contact us and we will work with the relevant delivery provider to resolve the issue. Where required by the Australian Consumer Law, we will provide the applicable remedy, which may include a replacement or refund.

If you are returning an item to us, we recommend using a tracked, registered shipping method — we are not responsible for return parcels that are lost in transit before they reach us.

Once an order has been delivered to the delivery address provided, responsibility for the parcel generally passes to you. We are not responsible for loss, theft or damage occurring after delivery, except where otherwise required by law.

 

CHANGE-OF-MIND

If you change your mind about the purchase of a full-priced item, you may return it within 7 days of delivery for a refund, exchange, or store credit, provided the item is in its original condition, unworn, unwashed, and has all original tags attached. SALE ITEMS

Discounted/sale items are eligible for exchange or store credit only.

Any item exchanged for a product marked as Final Sale cannot be returned or exchanged, unless it is deemed faulty, incorrect or misdescribed.

Items marked as Final Sale are not eligible for change-of-mind returns, exchanges, store credit or refunds.

FAULTY, INCORRECT OR MISDESCRIBED ITEMS

Claims relating to faulty, incorrect or misdescribed items are not subject to our 7 day change-of-mind period, and may also apply to sale items. The original-condition and tags-attached requirements do not apply to these claims.

We may inspect the item and ask you to provide reasonable proof of purchase. The remedy available will depend on the nature of the problem:

  • For a major problem, you may choose a refund or a replacement.
  • For a minor problem, we may repair the item, replace it, or provide a refund.

If we confirm that the item has a problem covered by the Australian Consumer Law, we will reimburse any reasonable return costs you have paid.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

 

GIFT CARDS

Unless otherwise stated, the following applies to all Unreal Fur Gift Cards purchased online:

  • Gift Cards are valid for 36 months from the date of issue.
  • Gift Cards can be redeemed in-store and online at www.unrealfur.com.au.
  • Gift Cards are non-transferable and cannot be returned, exchanged or redeemed for cash.
  • If your order total is less than the Gift Card value, the balance remains on the card for future use.
  • If your order total exceeds the Gift Card value, the difference must be paid by an alternate payment method.
  • Only one Gift Card may be redeemed per online transaction (multiple cards may be used in-store, if applicable).
  • Items purchased with a Gift Card can only be returned for a Gift Card re-issue, not a cash refund.
  • We are not responsible for a Gift Card sent to an incorrect or non-existent address or email — this is the purchaser's responsibility.
  • We are not responsible for Gift Cards that are lost, stolen, destroyed or used without permission.
  • We may cancel a Gift Card where necessary, subject to applicable law.
  • Promotional codes cannot be used to purchase a Gift Card unless otherwise stated.

 

PROMOTIONAL CODES

Promotional codes are non-transferable, have no cash value, and only one code may be applied per order unless stated otherwise. Codes cannot be combined with other offers or applied retrospectively to past orders or Gift Card purchases, and must be used within any stated validity period. 

 

SMS & EMAIL MARKETING

If you opt in to receive marketing communications from us by SMS or email, you consent to receive updates, offers and promotions via that channel. Message and data rates may apply to SMS and are your responsibility. Consent to receive marketing messages is never a condition of purchasing from us. You can unsubscribe at any time. ACCURACY OF INFORMATION

We aim to keep information on the Site — including product descriptions, images, pricing, sizing and colour — accurate and up to date, but errors may occur, and screen displays can vary between devices, so colours and finishes may appear slightly different in person. Product fit may also vary between individuals. We may correct errors or update information at any time without notice, and may cancel an order affected by a material error, in which case we will refund any amount paid.

 

DISCLAIMER

Content on the Site is provided "as is" for general information purposes. To the extent permitted by law, we make no warranties about the accuracy, completeness or reliability of the Site or its Content, and any reliance you place on it is at your own risk. We do not guarantee the Site will be uninterrupted, error-free, or free of viruses, and you access the Site at your own risk.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law, or any other right that cannot lawfully be excluded.

 

LIMITATION OF LIABILITY

Subject to our Disclaimer clause, and to the extent permitted by law, Unreal Fur, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors will not be liable for loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind — including, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs — arising from your use of, or inability to use or access, the Site.

 

INDEMNITY

To the extent permitted by law, you indemnify Unreal Fur and its personnel against any loss, liability or cost (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Site.

 

GENERAL

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. We are not liable for delays or failures caused by circumstances beyond our reasonable control (including force majeure events). We may assign or subcontract our rights and obligations under these Terms; you may not do so without our written consent.

 

GOVERNING LAW

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria in relation to any dispute arising out of or in connection with the Site or these Terms.
